Revocable Living Trusts – the drawbacks

As noted in a previous article, for a Revocable Living Trust to operate as intended, it has to be funded. If you fail to be thorough to ensure that your Revocable Living Trust has either present title to your assets or will have future title to them, then your estate might not be able to avoid Probate Court. Fees for establishing a Revocable Living Trust-based estate plan are higher than the fees for establishing a Will-based estate plan. These fees have to be considered in light of the customary probate fees in your jurisdiction. In some jurisdictions the benefits of avoiding Probate Court are greater than in other jurisdictions.
